This course provides a structured and practical analysis of dual intent in Canadian immigration law. It examines the statutory framework, officer decision-making patterns, drafting strategies, and Federal Court trends that shape outcomes in temporary residence applications involving permanent residence intentions.
Participants (RCICs and RISIAs) will develop the ability to interpret dual intent correctly, anticipate officer concerns, structure persuasive submissions, and apply jurisprudential insights to strengthen immigration applications. The course integrates legal principles with practical drafting and evidentiary techniques to enhance professional competence in complex temporary residence cases.
Participants will learn how to:
Correctly apply the legal test for dual intent under IRPA s.22(2)
Distinguish lawful dual intent from failure to satisfy temporary compliance
Identify common refusal patterns in TRV and study permit cases related to dual intent
Draft persuasive submissions demonstrating compliance with temporary resident obligations
Understand Federal Court trends shaping officer reasoning and refusal vulnerabilities
Participants must complete the course module by module in sequential order. Each module must be completed before proceeding to the next. Completion of the course quiz is required in order to successfully complete the course.
